If the Constitution is the supreme law of the land and all of the members of Brevard County School Board all have taken a solemn oath to preserve, protect and defend the Constitution, Three of the five members of the school board votes decided to enforce a district policy and ignore the Constitution.

When the Brevard County School Board fired a teacher for testing positive on a random drug test,  they violated the provisions of the Fourth and Fifth Amendments. Before a person can be searched a warrant signed by a judge is required and there needs to be a reasonable suspicion that a crime has been committed.

In Florida, the use of medical marijuana is not  a crime and warrantless searches violated both her 4th and 5th rights.

The Fifth Amendment mandates that one can be compelled to testify against themselves and when an employee is required to be drug tested they are assumed to be guilty until proven innocent.

Any tune a Board Policy violates the Constitutional rights of their employees  that policy needs to be re-examined.

When Board Members support polices that violate the Constitution they are violating their oath to preserve, protect and defend the Constitution.

The Fifth Amendment guarantees that no one can be compelled to testify against themselves. Requiring a teacher to be tested force them to testify against themselves.

Why should he Brevard County School Board members allow teachers hooked on prescribed pain medication be to be employed while teachers that manage their pain with medical Marijuana are subject to being fired.

School Boards members should not have a policy that promotes a double standard. They Boards must stop drug testing unless their is a probable cause and a search warrant.

Apparently being hooked on prescription medication is permissible, but relieving one's pain with medical marijuana is not. Medical marijuana is legal in Florida and the board is punishing a teacher that has broken no law.

The Brevard County School Board policy does not trump Florida State Laws or the Constitution for the united States.

The residents of Brevard County should file affidavits claiming that the members of their Board of Education have violated their oath of office terminating a teacher that has committed no crime.
