Utah, Mississippi, Kentucky, Georgia, Florida, South Carolina and Virginia have never ratified the 17th Amendment and have a right to nullify the 17th Amendment in their state.
A provision in Article V guarantees that no state can be deprived of equal suffrage in the senate without their consent.
There are currently 41 states that have ratified the 17th Amendment. .
