The Constitution guarantees the people with the freedom of speech, the freedom of religion, the freedom of the press along with the right to peacefully assemble and the right to petition our government for a redress of grievance, but it does not guarantee the people with the right to vote,

In order to function properly the people would need to employ both direct and indirect elections, The members of the House of Representatives were to be chosen by direct democratic elections while the senators were to be chosen by state legislators in indirect elections, 

The President would also be chosen in an indirect election by wise men of integrity who would prevent the tyranny of a majority.

The founding fathers did not trust the judgment of the masses of ignorant and uninformed voters, They believed a panel of wise men of integrity were better qualified to choose the President.

The founders also believed that allowing the legislatures of the states to choose their senators would provide the states with ability to prevent the House of Representatives from passing laws that the states believed were unconstitutional.

In order to guarantee that the states would never lose their suffrage in the senate an amendment protection clause was added to Article V which mandated that no state could be denied its equal suffrage in the senate without their consent.

In order for the 17th amendment to have been lawfully ratified it would have required the approval of all of the 48 states that existed when it was first proposed.
