According to the Supremacy clause found in Article VI all statutes passed by Comgress that do not conflict with the Constitution are Constitutional.Statutes violate provisions found in the Constitution are null and void.
In 1929 Congress passed a statute known as the Permanent Apportionment Act that limited the number of Congressional sats to 435.
This Act violated the equal protection clause of the 14th amendment which required that all of the people in all of the states must be equally represented.
The people in Wyoming have 1 reprentative for 575,000 and Montsns has 1 represemtative for over 900,000. In other words nearly 400,000 people in Montana are not being counted for the purpose of Congressionsl apportionment.
In order to comply with the 14th Amendment every Congressional Distrcit in all of the states must be equally represented. For every state to be requally represented every distruct must equal to the 575,000 constituents in Wyoming's Comgressional District.
This action would increase the membership in the House from 438 to 572 representatives.
