If There is No Victim, There is No Crime

In order tor a crime to take place they must first create a victim. The individual accused of a crime must violate the life, liberty or property of another individual. One of the rights mandated in our Bill of Rights is that a person accused of a crime has the right to cross examine the witnesses against him. In other words, the defendant has a right to confront the injured party.

If there is no injured party, and hence, no one to cross examine, the individual accused of the crime cannot defend himself in a court of law.

A government is a legal fiction and has no rights and cannot be an injured party. Only human beings have rights. Individuals can testify against an accused person but a legal fiction cannot. When an unjust law is enforced, the accused individual becomes a victim.

Amendment VI

"In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense."

Ninety-eight percent of the people in prison were denied their right to a trial by a jury. In order to avoid the possibility of being convicted of a more serious crime the accused pleads guilty to a lesser crime. In many cases they have committed no crime at all. This practice is an enemy of justice and a great way to raise money for corrupt lawyer and judges.

In the land of the free, we have more of our people in prison than any other country in the world. The biggest crime today is that we incarcerate people for committing victimless crimes.

A crime has been committed only when the life, liberty or property of one human being is violated by another human being. In order for a crime to take place there must be both a victim and a person responsible.

We have a God given right enumerated in the Fifth Amendment that guarantees those suspected of a crime will have the opportunity to cross examine the witnesses against them. When there is no victim there is no one to testify against the accused.

Only individuals have rights and artificial persons such as corporations can not testify in a court of law. 

When people violate a rule, regulation, code, ordinance or statute they have not violated the law and have not committed a crime.

  There have been many incorporation dates as they worked through bankruptcies reorganizations and so forth so most any incorporation date you have heard is probably correct as far as it goes. The main thing is, if a person loves the country they should get out from under the corporation called United States, US etc. and get into the country they thought they were in all along, where freedom actually exists and there are no doublespeak tax codes, presidents of corporations instead of presidents of the country etc. I always thought if a person was born here he or she was automatically a US citizen. That's not actually correct. Whether you become a citizen of the corporation or of the real country you must publicly take an oath to that country. One of the international human rights is that you may change or choose citizenship at any time.

The News Media has been referred to as "The Fourth Estate", but I doubt you are joining, that group, so give us a peek, Morton!

I have been on and off of this site, for some time now and some of the truths found here are difficult to grasp, since it is counter to all we have been taught, pledged allegiance to and served in the Military of.

We have witnessed  the not so gradual Socialization of our nation, discovered how we were hoodwinked, by the international cartel of banksters, through the thin air manufactured currency/inflation cycle 

and are numb from being misdirected, misunderstood, misused and outright abused, by a rapidly growing "Big Brother" political system.

The tragedies of folks like the Bundy family, LaVoy Finnicum, Branch Dividians, the Weaver family and who knows how many more, at the hands of a rogue government cannot be tolerated.

We know change is coming, but the pendulum must swing in the opposite direction! How to accomplish that is the question?

The Fourth Branch will be addressing these issues and more, with an eye toward solutions and accurate working affidavits and lawful filings to combat the fraud and completely rebut and refute any and all assumptions that are contrary to the truth. We the people, will rest control from the evil doers.

As for now, I have not yet begun this new site, but I assure you it will not be long before you will receive your invitation to join.

Here is another view, opinion and counter-point to consider:

With the corrupt "judicial system" set up as it is, often prosecutors claim "the state" or the "government" are the "victims."  While I will delete the applicable expletives that should accompany such statements, this is part and parcel of the "corporate government" that replaced our Republic in the 1860s thanks to Abraham Lincoln.

When and until we can eliminate a "corporation" as being a "personalty" or "person" for most if not all applicable "legal" terminology, we will continue to have these problems among so many others.

Also consider this, think about Bundy Ranch, murder of Lavoy Finicum and the confiscation of land by the renegade "federal government" (look at my now home Nevada State)...how can a "government" own anything unless it has achieved the status of a "person" through corporate personalty? (Rhetorical question...and the term is spelled correctly by the way.)

This is one of but many issues we also need to pursue to reclaim our Republic.

End the fed; restore common law; common law courts and our Constitution as originally drafted; and for God's sake, term limit these Congressional criminals as AmericaAgain suggests in the action plan to return Congress home.  Neither politics nor judgeships should be paths to riches.  And we must stop allowing the globalists to keep us in perpetual war to control us.  The only wars are banker wars (Google it and view the short video).

By the way, a distant relative of mine, Robert Morris (7th great uncle) signed the Declaration of Independence, Articles of Confederation and Constitution...its in my blood.

Keep fighting, complacency breeds destruction and is the path we're otherwise on.

No government job should be a path to riches, it's supposed to be service, not a job and especially not a career.

Also, for clarity, personality would suffice to say the same thing. Either way we're talking about anthropomorphising a fiction. And you're right. The state, read all fictions, cannot be a victim.

We need to end the IRS too. And the book/video is called All Wars are Banker's Wars. Another good read is "The Creature From Jeckyl Island."

   You know, I think we should go even farther. Not only it shouldn't be a path to riches, but if a person actually wants that job he shouldn't be allowed to run for it. We should want fully qualified and dedicated people who don't believe a government office is the ultimate goal in life.
