The united States is a union of 50 separate and independent republics that have banded together for their mutual benefit. The government created by the states was granted a short list of well defined powers.
The primary job on Congress is to provide for the common defense, establish justice, insure domestic tranquility and promote the general welfare. It was not given the authority to do anything that was specifically delegated to them in the Constitution.

The Constitution was not written to govern the people, it was written to govern the government. People are responsible to govern themselves and when they violate the rights of others they need to be punished. That is one of the legitimate functions of government.
Representatives from the states wrote the Constituton to create a more perfect union, not an all powerful central government. The people were supposted to be the masters and the central government was to be our servant.
