With the ratification of the 14th Amendment all persons of African descent that were born in the United States were granted instant citizenship. It was not the intention of the amendment to grant citizenship to thr children of illegal aliens.
“Subject to the jurisdiction thereof” is a phrase from the 14th Amendment of the U.S. Constitution that means owing allegiance to the United States and not to any other country. This phrase is part of the Citizenship Clause, which establishes the principle of birthright citizenship.
Children born in the United States to parents that were not lawful residents at the time of their birth are not subject to the jurisdiction of the United States and do not qualify for birthright citizenship.
Native American were not eligible for birthright citizenship because they owed their allegiance to their tribe and children born to illegal aliens owe their allegiance to the country where their parents were born..
The Indian Citizenship Act of 1924, also known as the Snyder Act, granted citizenship to all Native Americans born in the United States. It was signed into law by President Calvin Coolidge on June 2, 1924.
Children inherit their citizenshiip from their parents and are subject to the jurisdiction of their parents,
The Supreme Court has never ruled that children of illegal aliens are entitled to birthright citizenship. President Trump is responsible to enforce the laws of the land and has the lawdul authority to enforce the prpvisions of the 14th Amendment.
Other groups that were denied citizenship included the sons and daughters born to the to foreign diplomats, foreign students, visitors and the children of illegal aliens.
