The Constitution of the United States that existed when the Constitutional Convention was held in Philadelphia required that any changes to the Articles of Comfederation would require the unanimous approval of all of the states,

Only 12 of the 13 states attended the Consttitutional Convention which made it an unlawful assembly with no authority to amend the Articles of Comfederation.

Lysander Spooner's "The Constitution of No Authority" takes the position that the delegates had no lawful  auhorityalter or amend the existing Constitution without the unanimous support of all of the states.
